1. Acceptance of Terms
By creating an account, accessing, browsing, purchasing, printing, contributing to, or otherwise using the Arcanetion Platform ("Platform"), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions, including any future modifications made by Arcanetion.
If you do not agree to these Terms, you may not access or use the Platform.
2. Limited License & Intended Use
Arcanetion grants users a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely for personal entertainment, gameplay, collection management, and community participation purposes.
Users may not:
- Copy, reproduce, scrape, reverse engineer, redistribute, or commercially exploit the Platform or its systems;
- Use the Platform for unlawful, fraudulent, abusive, or commercial purposes not expressly authorized by Arcanetion;
- Attempt to bypass account limitations, moderation systems, payment systems, or security protections;
- Use automated systems, bots, scripts, or unauthorized software to interact with the Platform.
Arcanetion reserves the right to suspend or terminate access for misuse of the Platform.
3. Intellectual Property Rights
All Platform software, systems, interfaces, gameplay mechanics, databases, card templates, layouts, designs, branding, logos, visual elements, written materials, source code, trade dress, and related content are protected by copyright, trademark, trade secret, and other intellectual property laws.
Arcanetion and its licensors retain all ownership rights, title, and interest in and to the Platform and its related technologies.
No ownership rights are transferred to users through Platform access or usage.
Users may not:
- Reproduce or redistribute Platform assets without authorization;
- Remove copyright or trademark notices;
- Claim ownership of Platform systems or mechanics;
- Use Arcanetion branding, trademarks, logos, or likenesses without written permission.
4. Fan-Created & Third-Party Content
Users acknowledge and agree that:
- Such content is unofficial and intended solely for private, personal, and non-commercial use unless explicitly authorized by the applicable rights holder;
- Arcanetion does not claim ownership over unauthorized third-party intellectual property uploaded by users;
- Arcanetion makes no representation that user-created fan content is legally authorized by original rights holders;
- Users remain solely responsible for any content they upload, create, distribute, or display through the Platform.
Arcanetion reserves the unrestricted right to remove, rename, alter, censor, disable, replace, or delete any content that may potentially infringe upon intellectual property rights or expose the Platform to legal liability.
5. Pending Patents & Proprietary Systems
Certain systems, mechanics, gameplay methods, software structures, printing processes, marketplace systems, and interactive features used by Arcanetion may be subject to pending patent applications, proprietary protections, confidential trade practices, or future intellectual property filings.
Nothing within the Platform grants users any ownership, license, or rights to reproduce or commercially exploit such systems.
Users agree not to copy, clone, imitate, replicate, reverse engineer, or commercially reproduce proprietary Platform systems or business methods.
6. User-Generated Content
By uploading, posting, creating, transmitting, or submitting any content to the Platform, users grant Arcanetion a perpetual, worldwide, irrevocable, royalty-free, sublicensable license to host, store, display, reproduce, modify, print, distribute, archive, market, and utilize such content in connection with Platform operations and services.
Users represent and warrant that:
- They possess sufficient rights to submit the content;
- Their content does not violate laws or third-party rights;
- Their content does not contain malicious code, fraud, harassment, or prohibited material.
Arcanetion reserves the right to remove or modify user content at any time and for any reason without notice.
7. Marketplace, Printing & Physical Products
All printing, manufacturing, fulfillment, and distribution services associated with Platform-generated assets shall be handled exclusively through providers selected or authorized by Arcanetion.
Users may not independently mass-produce, commercially print, or distribute Platform-generated assets without written authorization.
Arcanetion does not guarantee:
- Product availability;
- Manufacturing timelines;
- Shipping speeds;
- Print quality consistency;
- Marketplace profitability or resale value.
All purchases are subject to availability and operational limitations.
8. No Warranty
To the fullest extent permitted by law, Arcanetion disclaims all warranties including:
- Merchantability;
- Fitness for a particular purpose;
- Non-infringement;
- Uninterrupted service;
- Error-free operation;
- Data preservation;
- Commercial success or profitability.
Arcanetion does not guarantee continuous availability of the Platform or compatibility with all devices, browsers, or operating systems.
9. Limitation of Liability
To the fullest extent permitted by law, Arcanetion, its affiliates, owners, employees, contractors, licensors, partners, and service providers shall not be liable for:
- Indirect or consequential damages;
- Lost profits or lost data;
- Service interruptions;
- User disputes;
- Intellectual property claims arising from user-created content;
- Unauthorized account access;
- Printing defects or fulfillment delays;
- Marketplace losses or failed sales.
In all circumstances, Arcanetion's total liability shall not exceed the amount paid by the user to the Platform during the ninety (90) days preceding the claim.
10. Indemnification
Users agree to defend, indemnify, and hold harmless Arcanetion and its affiliates from and against any claims, liabilities, damages, losses, expenses, or legal fees arising from:
- User-created content;
- Intellectual property disputes;
- Violation of these Terms;
- Fraudulent or unlawful conduct;
- Unauthorized commercial activity;
- Misuse of the Platform.
11. Account Suspension & Termination
Arcanetion reserves the right to suspend, restrict, disable, or permanently terminate any account or Platform access at any time and without prior notice for conduct including but not limited to:
- Intellectual property violations;
- Harassment or abuse;
- Fraudulent activity;
- Payment disputes or chargebacks;
- Exploitative behavior;
- Unauthorized commercial use;
- Attempts to interfere with Platform operations.
Termination does not eliminate licenses or rights previously granted to Arcanetion under these Terms.
12. Dispute Resolution & Arbitration
By using the Platform, users agree that any dispute, controversy, or claim arising from the Platform or these Terms shall first be addressed through informal negotiation.
If unresolved, disputes shall be settled exclusively through binding arbitration or mediation in the State of Florida, unless prohibited by applicable law.
Users waive the right to:
- File lawsuits in court;
- Participate in class-action proceedings;
- Request jury trials relating to Platform disputes.
Nothing in this section limits Arcanetion's right to seek injunctive relief related to fraud, abuse, intellectual property misuse, or unauthorized commercial activity.
13. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Florida, United States, without regard to conflict-of-law principles.
14. Updates to Terms
Arcanetion may modify or update these Terms at any time.
Continued use of the Platform following updates constitutes acceptance of the revised Terms.
Users may be required to re-accept updated Terms before continuing Platform access.
15. Acknowledgment
By registering an account or using the Platform, users acknowledge that they understand the Platform contains user-generated content, unofficial fan-created content, evolving systems, marketplace features, and experimental gameplay mechanics that may change, be removed, or become unavailable at any time without liability to Arcanetion.
